Don't be Loco! Protect Your Logo!

Salam Everyone,

Today, I will share with you how to get your logo / image trademark for copyright protection!

Yes! In a country like Malaysia where piracy is rife, one thing is certain, if your idea is great, it will definitely be copied.

That little thing next to your logo ;)

If you have been catching up on recent new, Naelofar Hijab (See Article Here), has filed a suit in Vietnam for allegedly copying her Hijab designs. Though I doubt she has copyright protection in Vietnam, it would definitely give her an edge in Malaysia, where she has filed for copyright protection. This way, no other parties can profit from her logo without her prior consent.

First and foremost! Locate the closest MyIPO Office near your state (Click Here). In my case, that would be at Wisma UOA Bangsar. I personally like the fact it is open really early at 8.15 am, where you can get a number and get what you need from the counter.

If you see this logo, you're absolutely correct!

Speaking of what you need, here's the list!
  1. TM5 Form - 5 Copies - For the Form, Click Here
  2. Commissioner of Oath Signature - 1 Copy - For The Form, Click Here
  3. Identification Card - 1 Copy
  4. An initial payment of RM 370. You will need to pay a further RM 650 upon approval of your application.
Do take note that, upon application, you are still not granted exclusive rights to the trademark, as that will only be done after 8 months. The reason I was given was MyIPO needs to check your trademark for any potential infringements with other company logo's and ensure yours do not breach any of their existing trademark.

Here's the flowchart (Click Here)

It was a relatively painless affair which only takes less than an hour to complete! If you are heading towards the Bangsar Office, come early and get it out of your hair so that you can rest easy knowing that your logo is protected (after 8 months that is!)

Next time, we will talk about how to file for patents, if there are enough demands for it! ;)

As always, thank you, and I wish you all the best!

Yours Always,

Arif Fauzi
